RSA, Network Associates settle lawsuit

RSA Data Security, Inc. and Network Associates, Inc. have settled patent
infringement and copyright lawsuits that RSA had filed against Network
Associates and two of its subsidiaries, the companies announced today.
As part of the settlement, Network Associates has a new royalty-bearing
license for RSA's crypto-security engines. The deal allows Network
Associates to include in its products RSA components, as well as those
from Network Associates subsidiaries Pretty Good Privacy, Inc. (PGP)and
Trusted Information Systems (TIS).
The settlement represents an end to both interoperability issues with
encryption algorithms for consumers, and a scuffle over standards, said
CEOs of both companies in a joint press and analyst conference today.
The companies are "declaring peace in avoidance of a standards war,"
Bill Larson, CEO and Chairman of Network Associates, said today.
"We're not religious about standards, we're businesspeople," he said.
The patent-infringement lawsuit was filed in 1997 after Network
Associates acquired PGP and its technologies. PGP allegedly was using
RSA's encryption algorithms.
The federal copyright lawsuit was filed last month and was related to
technology NAI acquired with the purchases of TIS and PGP. RSA had been
licensing encryption technology since 1992 to TIS, which was
incorporated into a variety of TIS firewall products.
The licensing agreements for those technologies became void when the NAI
acquisition of TIS became final in late April. RSA and NAI were unable
to come to terms on the licenses, so RSA filed suit.
As part of the settlement, NAI will pay RSA an undisclosed sum from an
escrow account set up at the time of the PGP acquisition to cover legal
fees and to clear past issues between the companies, it was announced.
"We're both happy with the outcome," RSA President and CEO James Bidzos
said of the settlement.
"Now we can get past all of the interoperability issues and continue to
grow the market," Bidzos said.
